Terms & Conditions

These terms govern the provision of legal services by Khantha Law. Please read them carefully before engaging our services.
1. About Us
Khantha Law is a legal practice registered and operating in Thailand, with offices at 234/5 Phra Athit Road, Phra Borom Maha Ratchawang, Bangkok 10200. All practitioners are registered members of the Thai Bar Association. References to "we", "us", or "the practice" in these terms refer to Khantha Law.
2. Scope of These Terms
These terms apply to all persons who engage Khantha Law for legal services, make enquiries through our website, or otherwise interact with our practice in a professional capacity. By engaging our services or submitting an enquiry, you confirm that you have read and understood these terms.
These terms do not form a complete statement of the legal services to be provided. The scope, cost, and specific terms of any engagement will be set out in a separate engagement letter issued at the commencement of each matter.
3. Services We Provide
Khantha Law provides legal services in the following areas:
- Pension documentation preparation for applications to the Social Security Office (SSO) and related authorities
- Survivor pension claim assistance for surviving spouses and dependants
- Representation in extended pension disputes, including administrative reviews and judicial proceedings
We do not offer services outside these areas without explicit prior agreement. Our services are available to individuals aged 18 and over, or to representatives acting on behalf of eligible claimants.
4. Engagement and Instruction
A formal engagement begins only when both parties have signed an engagement letter, and any initial payment agreed in that letter has been received. An enquiry submitted through our website or by email does not constitute an engagement, and we are under no obligation to accept any particular matter.
We may decline to act if we consider there is a conflict of interest, if the matter falls outside our areas of practice, or if we do not consider it appropriate to proceed for any other professional reason. We will notify you of such a decision without undue delay.
5. Fees and Payment
Our fees are set out in the engagement letter for each matter. Standard fees are as follows:
- Pension Documentation Preparation: ฿4,200
- Survivor Pension Claim Assistance: ฿16,800
- Long-Term Pension Dispute Representation: ฿33,200
Fees are payable in Thai Baht. Payment terms, including any instalment arrangements or stage payments, will be set out in the engagement letter. We reserve the right to suspend work on a matter if invoices remain unpaid beyond their due date.
Disbursements — including filing fees, court fees, translation costs, and the cost of obtaining official records — are charged separately and at cost, with your prior knowledge.
Fees are not contingent on outcome. We are transparent about this at the outset of each engagement.
6. Scope of Legal Advice
All advice provided by Khantha Law relates to Thai law as it stands at the time advice is given. We do not advise on foreign law. Our advice is based on the information you provide, and the accuracy of that advice depends on the completeness and accuracy of the information we receive.
Legal advice provided in connection with one matter does not apply to other matters unless explicitly stated. We will advise you if we consider that a related issue falls outside the scope of the current engagement.
7. Client Responsibilities
You agree to:
- Provide accurate and complete information relevant to your matter
- Notify us promptly of any changes to your circumstances that may affect the matter
- Respond to our communications within the timeframes we request, where deadlines are involved
- Provide original or certified documents when required by the relevant authority
We are not responsible for delays or adverse outcomes arising from incomplete or inaccurate information provided by you, or from your failure to respond to requests within required timeframes.
8. Confidentiality
We treat all information provided in connection with a client matter as confidential. We will not disclose your information to third parties without your consent, except where required by law, by the rules of our professional body, or as necessary to progress your matter with the relevant authority.
Confidentiality obligations survive the conclusion of the engagement.
9. Conflicts of Interest
We check for conflicts of interest at the outset of each engagement. If a conflict arises during the course of a matter, we will notify you promptly and discuss how it should be managed. In some cases, it may be necessary for us to withdraw from acting.
10. Limitation of Liability
We exercise professional care in all work undertaken. However, we do not accept liability for:
- Decisions made by regulatory authorities or courts
- Outcomes that are within the discretion of a third party and outside our control
- Loss arising from inaccurate or incomplete information provided by the client
- Indirect or consequential losses
Our liability in connection with any engagement is limited to the fees paid under that engagement, except where such limitation is excluded by Thai law or by applicable professional regulations.
11. Termination
Either party may end an engagement by written notice. If you choose to end an engagement, fees for work completed to that point remain payable. We may terminate an engagement if you have not complied with these terms, if you have provided materially inaccurate information, or if continued representation would place us in professional difficulty. We will give reasonable notice and take steps to minimise disruption to your matter.
12. Records and File Retention
At the conclusion of an engagement, we will return original documents you have provided. We retain copies of matter files for a minimum of 10 years in accordance with professional requirements. After that period, files may be destroyed without further notice.
13. Website Use
The content on our website is provided for general information purposes only. It does not constitute legal advice and should not be relied upon as such. We make reasonable efforts to keep the content current, but we do not warrant its accuracy or completeness.
We are not responsible for the content of external sites linked from our website.
14. Intellectual Property
All content on our website, including text, structure, and design, is the property of Khantha Law. It may not be reproduced without our written consent.
15. Governing Law and Disputes
These terms are governed by the laws of Thailand. Any dispute arising from these terms or from the provision of our services will be subject to the exclusive jurisdiction of the Thai courts, unless an alternative resolution method has been agreed in writing.
16. Changes to These Terms
We may update these terms from time to time. The current version will always be available on our website. Changes take effect when published and apply to engagements entered into after that date.
