Case Study 01 — Documentation
Self-Employed Period Complicating a Standard Application
Challenge
A client with 28 years of combined employment history — including eight years of self-employment — had received conflicting advice on which documents were required and whether the self-employed period would count toward entitlement.
Solution
We reviewed the contribution record in detail, confirmed which periods were eligible and which were not, identified the supplementary documentation available for the self-employed period, and prepared a complete file with a covering letter explaining the employment history clearly.
Outcome
The application was submitted in a single complete filing. It was accepted without follow-up queries within the standard processing period of the relevant office.
Case Study 02 — Survivor Claim
Survivor Entitlement Following Complex Employment History
Challenge
A widow sought entitlement to her late husband's pension. His employment history included periods in both the private sector and a government agency, creating a split entitlement situation that the family had not anticipated. One dependant was a child still in full-time education.
Solution
We assessed entitlement under both the Social Security Act and the Government Pension Fund Act, identified which authority was responsible for each portion, and prepared separate claim files for each. The consultation schedule was adapted to the family's availability.
Outcome
Both claims were filed. The GPF portion was resolved first; the SSO portion followed approximately six weeks later. The client was updated at each stage and understood what was outstanding at any given point.
Case Study 03 — Dispute
Administrative Review Following Repeated Denial
Challenge
A client came to us after two denials. The first had been handled without legal assistance; the second had been handled by a general practice. The refusal letters cited a contribution gap that the client disputed, and records from a former employer were difficult to obtain.
Solution
We reviewed both refusal decisions, assessed which grounds were sound and which were contestable, obtained a statutory declaration from a former colleague to support the disputed period, and lodged an administrative review application with detailed submissions on the contribution record.
Outcome
The review resulted in a partial correction of the contribution record. The entitlement was recalculated accordingly. The client was informed throughout that full resolution was not certain, and the outcome — while not complete — was better than the status quo.
